Araniko AI – Terms of Service

Welcome to Araniko AI (“Company”, “we”, “us”, or “our”), a service owned and operated by Uttam Adhikari (“Founder”). These Terms of Service (“Terms”) govern your access to and use of the Araniko AI platform, accessible at https://araniko.ai, including its subdomains and related tools, products, and services (collectively, the “Platform” or “Service”).

By accessing or using the Service, you (“User”, “Customer”, or “you”) agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Eligibility

To use the Service, you must be at least 18 years old and capable of forming a binding legal agreement. By using the Service, you affirm that you meet these eligibility requirements.

2. Service Description

Araniko AI is an AI-powered customer support and sales agent, delivered as a JavaScript widget that can be embedded in websites. It automates customer interaction by understanding user intent, collecting lead data, and relaying it to business administrators via a secure backend system.

  • Multi-plan subscription options (Free, Starter, Business)
  • Admin dashboard for response management and reporting

3. Account Registration

To access full functionality, Users must create an account. You agree to:

  • Provide accurate, complete information;
  • Keep your login credentials secure;
  • Accept responsibility for any activity under your account;
  • Promptly update your information when necessary.

4. Subscription and Payments – Paddle as Merchant of Record

All orders for Araniko AI are processed securely through our authorized reseller, Paddle.com, who serves as the Merchant of Record. Paddle handles all billing, payment processing, invoicing, customer inquiries, and refund requests on our behalf.

“Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.”

We do not store or have access to your credit card or payment information. All payments are securely processed through Paddle’s PCI DSS-compliant platform.

Purchase Terms

By purchasing Araniko AI, you agree to the following:

  • You understand the exact features, limitations, and pricing of the product or subscription you’re purchasing.
  • All pricing, including any recurring subscription charges, will be clearly shown before checkout.
  • A receipt and fulfillment email (including product access instructions) will be sent automatically after a successful purchase.
  • You are advised to review our Terms & Conditions and Refund Policy before placing any order.
  • You agree to Paddle’s Terms and Privacy Policy during checkout.
  • Product access is immediate upon payment confirmation unless otherwise stated.

Refunds and Cancellation

We follow Paddle’s refund procedures. If you request a refund, it must be made within 14 days of purchase, unless stated otherwise. Please contact theuttamadhikari@gmail.com for assistance or reach Paddle directly via https://paddle.net.

If you are a Consumer and unless the below exception applies, you have the right to cancel this Agreement and return the Product within 14 days without giving any reason. The cancellation period will expire after 14 days from the day after completion of the Transaction. To meet the cancellation deadline, it is sufficient that you send us your communication concerning your exercise of the cancellation right before the expiration of the 14 day period.

To cancel your order, you must inform Paddle of your decision. To ensure immediate processing, please do so by contacting us here. Please note that in respect of subscription services your right to cancel is only present following the initial subscription and not upon each automatic renewal.

a. Plans & Billing

We offer monthly and annual subscription plans. Payments are due in advance of the subscription period.

  • Monthly plans: Auto-renew every month
  • Annual plans: Discounted 20% and billed as a single upfront payment

b. Payment Authorization

By subscribing, you authorize Araniko AI to charge your payment method on a recurring basis until you cancel.

c. Pricing Changes

We may change our pricing at any time. Affected users will be notified at least 15 days in advance.

5. Acceptable Use & Restrictions

You agree not to:

  • Use the Service for unlawful, harmful, or deceptive purposes;
  • Modify, reverse engineer, or tamper with any part of the Platform;
  • Interfere with platform performance or compromise its security;
  • Abuse or overload the system (e.g., bot traffic, spam activity);
  • Use the chatbot to collect sensitive data (e.g., passwords, credit card info) without proper compliance.

We reserve the right to suspend or terminate access if these guidelines are violated.

6. Data Ownership & Privacy

Your data remains yours. Araniko AI does not claim ownership of chatbot conversations, leads, or other data you input or receive.

By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of operating and improving the Platform.

7. Intellectual Property

All materials, designs, source code, brand assets, and functionalities of Araniko AI are the exclusive intellectual property of Araniko AI and Uttam Adhikari. These materials are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy or reuse code from the Platform;
  • Use our trademarks or branding without prior written permission;
  • Create derivative works based on the Service.

8. Termination & Suspension

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or suspected abuse. Upon termination:

  • Access to your account and data will be revoked;
  • Your data may be deleted after 30 days, unless otherwise required by law;
  • No refunds will be issued for any remaining subscription period.

You may cancel your subscription at any time from your account dashboard.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind. We disclaim:

  • All implied warranties, including merchantability and fitness for a particular purpose;
  • Any warranty that the Service will be uninterrupted, error-free, or completely secure;
  • Responsibility for any damages from data loss, service unavailability, or user errors.

10. Limitation of Liability

To the maximum extent permitted by law, Araniko AI, its founder, employees, or affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages;
  • Loss of data, revenue, or profits;
  • Damages arising out of your use or inability to use the Service.

Our total liability for any claim under these Terms is limited to the amount paid by you in the 3 months preceding the claim.

11. Changes to Terms

We may revise these Terms periodically. Material changes will be communicated via email or dashboard notification.

Continued use of the Service after updates constitutes your acceptance of the new Terms. If you disagree with any changes, you should stop using the Service and cancel your account.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nepal.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kathmandu, Nepal.
